This message and any accompanying information are protected under the Federal regulations governing Confidentiality of Substance Use Disorder Patient Records, 42 C.F.R. Part 2, and the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), 45 C.F.R. Parts 160 & 164, and may not be disclosed without proper written consent unless otherwise permitted by law.
Federal law prohibits the unauthorized disclosure of this information unless further disclosure is expressly permitted by the written consent of the individual to whom it pertains or as otherwise allowed under applicable law and regulations. The Federal rules restrict any use of this information to criminally investigate or prosecute any alcohol or drug abuse patient.
If you are not the intended recipient, please notify the sender immediately by reply email or telephone and permanently destroy all copies of the original message and attachments. All information contained herein is strictly confidential.

Your Rights Regarding Your Health Information
Access to Your Records
You have the right to inspect and obtain a copy of your medical and billing records maintained by LVX Recovery, subject to limited exceptions permitted by law.
Request Amendments
If you believe your health information is incorrect or incomplete, you may request an amendment to your records.
Request Confidential Communications
You may request that we contact you in a specific way or at a designated location to maintain confidentiality.
Request Restrictions
You may request restrictions on how your PHI is used or disclosed for treatment, payment, or healthcare operations. While we will consider all requests, we are not always required to agree.
Accounting of Disclosures
You have the right to request a list of certain disclosures of your protected health information made by LVX Recovery.
Right to a Paper Copy
You may request a paper copy of this HIPAA Privacy Policy at any time, even if you previously agreed to receive it electronically.
How We May Use and Disclose Your Information
Treatment
We may use and disclose your health information to provide, coordinate, or manage your healthcare and treatment services.
Payment
We may use or disclose your information to obtain payment for healthcare services provided to you.
Healthcare Operations
We may use your information for operational activities including quality improvement, staff training, licensing, accreditation, and administrative functions.
As Required by Law
We may disclose your information when required by federal, state, or local law.
Public Health and Safety
We may disclose information when necessary to prevent or lessen a serious threat to health or safety or when reporting abuse, neglect, or domestic violence as required by law.
Law Enforcement and Legal Proceedings
We may disclose information pursuant to court orders, subpoenas, warrants, or other lawful processes consistent with HIPAA and 42 C.F.R. Part 2 requirements.
Research
In limited circumstances, we may use or disclose health information for approved research purposes in compliance with applicable laws and institutional safeguards.
Special Protections for Substance Use Disorder Records
Records relating to substance use disorder diagnosis, treatment, or referral are protected under Federal law and regulations, including 42 C.F.R. Part 2.
Generally, LVX Recovery may not disclose information identifying an individual as having or having had a substance use disorder unless:
- The individual provides written consent;
- The disclosure is permitted by a court order;
- The disclosure is made to medical personnel during a medical emergency;
- The disclosure is otherwise permitted under applicable federal regulations.
Unauthorized disclosure of protected substance use disorder treatment records is prohibited and may result in penalties under federal law.
Our Responsibilities
LVX Recovery is required by law to:
- Maintain the privacy and security of your protected health information;
- Provide you with this Notice of Privacy Practices;
- Notify you following a breach of unsecured protected health information when required by law;
- Follow the terms of this Notice currently in effect.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with LVX Recovery or with the U.S. Department of Health and Human Services Office for Civil Rights.
Filing a complaint will not affect the quality of care you receive, and no retaliation will occur for filing a complaint.
